Terms and Conditions of Use for End Users Accessing the ShoWhere Online Platform
These terms and conditions of use apply to any end user of the ShoWhere online platform, which hosts the indicators generated by ShoWhere: https://showhere.fr/espace-client.
An end user (hereinafter referred to as "user") is defined as any individual accessing one of the services offered by the ShoWhere platform and having an access account created by ShoWhere.
Indicators (hereinafter referred to as "indicators") are defined as local data made available to the user on the ShoWhere platform.
Definition and Purpose of the Online Service
The ShoWhere online platform is a secure platform that the user can access using a username and a password. This platform allows the user to:
- visualize target indicators at different resolution levels,
- create, manage and obtain aggregated results on areas of interest such as catchment areas, commercial prospecting zones, distribution areas, etc.,
- cross-reference target indicators with other indicators such as profiles, media, etc., on a country-level or on specific areas of interest,
- export indicators and results to integrate them into user’s work environment, such as Excel, geographic information systems (GIS), media planning tools, etc.
Use of the Online Service (hereinafter referred to as "platform")
Use of the platform is restricted to users authorized by ShoWhere. Each user must log in with their personal credentials and is responsible for keeping their username and password confidential.
Maintenance
The platform may undergo periodic maintenance to improve performance and add new features. During these maintenance periods, ShoWhere strives to keep the platform functional. However, the user is asked to report any malfunction so that ShoWhere can solve it as soon as possible.
Definition of Indicators
ShoWhere indicators are generated using geostatistical cross-analysis of:
- consumer survey responses collected on a nationally representative basis (gender, age, social class, region) and through large panels,
- open-source socio-demographic census data.
Under no circumstances do the indicators constitute personal data. They are the result of modelling and/or reflect average estimates over a geographical area.
Ownership of Indicators
The indicators available on the platform are the property of ShoWhere. They are intended for internal use within the user's organization, unless otherwise stipulated in a contract signed between ShoWhere and the user.
Intellectual Property Protection
ShoWhere emphasizes the importance of protecting intellectual property related to its platform, including technologies, methodologies, modeled data, know-how, and other sensitive business information developed and utilized by ShoWhere.
Intellectual Property Rights
All intellectual property rights related to the ShoWhere platform, including:
- software: all computer programs, applications, scripts, and other software developed or used by ShoWhere to provide its services.
- databases: structured collections of data organized for electronic processing that can be protected by database rights or other intellectual property laws.
- modeling methodologies: techniques, methods, algorithms, and procedures used by ShoWhere to generate, process, analyze, or interpret data and indicators.
- generated content: any content, such as reports, analyses, visualizations, charts, maps, text, images, videos, or other items created or generated by ShoWhere as part of its services.
are and remain the exclusive property of ShoWhere. User’s access to and use of the ShoWhere platform does not grant them any rights over ShoWhere's intellectual property resources, unless such rights are explicitly granted by these Terms and Conditions or upon specific request to ShoWhere.
Confidentiality and Non-Disclosure
The user undertakes to maintain the confidentiality of all information related to ShoWhere's methodologies, technologies, and modeled data encountered while using the platform. Disclosure of proprietary or confidential information to third parties without prior written consent from ShoWhere is prohibited. This confidentiality obligation persists beyond the duration of the user's use of the platform.
Authorized Use
The user may only use ShoWhere's intellectual property resources for the purposes permitted under these Terms and Conditions. Any unauthorized use, including modification, reproduction, distribution, or creation of derivative works based on ShoWhere's intellectual property, is strictly prohibited.
Measures for Violations
ShoWhere reserves the right to take necessary actions, including legal proceedings, to protect its intellectual property rights and address violations of confidentiality and non-disclosure commitments stipulated in these Terms and Conditions.
Liability
ShoWhere cannot be held liable for damages caused by incorrect or unauthorized use of the data or the online service. We reserve the right to suspend or terminate access to the online service in case of a violation of these Terms and Conditions of Use.
Collection and Use of Activity Data
Certain activity-related data may be collected and recorded while using the ShoWhere platform. These data are used solely for the following purposes:
- Ensuring the security of the platform and user data.
- Preventing and detecting unauthorized or abusive activities.
